Terms & Conditions

These Terms & Conditions govern your use of Profit Forge (the "Service"), available at profitforgehq.com. The Service is provided by Summit Commerce Group, LLC ("we", "us", "our"). By creating an account, subscribing or continuing to use the Service, you agree to these terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be of legal age to form a binding contract. If you use the Service on behalf of a company or other organisation, you confirm that you have authority to bind that organisation to these terms.

2. The Service

Profit Forge is a subscription web application that helps you plan, evaluate and validate business concepts for domains you own. It includes AI-assisted research, generation and review features. Outputs are suggestions for your own evaluation; they are not professional, financial, investment, legal or tax advice, may contain inaccuracies, and must be reviewed by you before you rely on or act on them. You remain responsible for your business decisions.

3. Your account

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your credentials confidential and for all activity under your account.
• Accounts are for a single user. Do not share access or resell your account.

4. Acceptable use

You must not:

• use the Service for anything unlawful, fraudulent, deceptive or abusive, including spam;
• infringe anyone's intellectual property, privacy or other rights, or submit content you do not have the rights to;
• generate or distribute illegal content, hate speech, harassment, malware, deepfakes or impersonation;
• attempt to interfere with, probe, scan, overload, scrape or reverse engineer the Service or circumvent its technical or usage limits;
• attempt to jailbreak, manipulate or extract the underlying AI prompts, models or systems;
• resell, redistribute or make the Service available to third parties.

You are responsible for the prompts and content you submit, for how you use any output, and for verifying that output is accurate and lawful before using it. We may remove or restrict content, filter or refuse outputs, and suspend accounts to enforce these rules. If you believe content produced or hosted through the Service infringes your rights, contact us at support@profitforgehq.com and we will review and, where appropriate, remove it; repeat infringement results in account termination.

5. Intellectual property

We own the Service and all intellectual property in it, including the software, prompts, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with your subscription for the duration of that subscription.

You keep ownership of the content and data you put into the Service. You grant us a limited licence to host and process that content solely in order to provide the Service to you. As between you and us, you may use the outputs generated from your inputs for your own business purposes, subject to these terms and to any third-party rights in the material you submitted.

6. Payment, subscription and taxes

Profit Forge Pro is a monthly subscription. Current pricing is shown on our pricing page. Subscriptions renew automatically each month until cancelled. A payment method is required to start a free trial; if you do not cancel before the trial ends, the subscription begins and the first charge is taken.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, invoicing, cancellation and refund mechanics are therefore also governed by Paddle's Buyer Terms. Refunds are described in our refund policy.

7. Availability

We aim to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free or free of downtime. Features may change, and third-party AI providers we rely on may change or become unavailable.

8. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may cancel at any time from the billing page in the app. When access ends, you may export your data for 30 days, after which we may delete it in line with our privacy notice.

9. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect, consequential or special damages, including lost profits, lost data or lost goodwill. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

10. Indemnity

You will indemnify us against claims arising from your content, your unlawful or infringing use of the Service, or your breach of these terms.

11. Changes to these terms

We may update these terms. Material changes will be notified by email or in the app before they take effect. Continued use after that date means you accept the updated terms.

12. Governing law and disputes

These terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law rules. The courts located in Indiana have exclusive jurisdiction over any dispute, except where mandatory consumer law gives you the right to bring proceedings elsewhere.

13. General

You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. If a provision is found unenforceable, the rest remains in effect.
